Laws & Regulations Two federal laws direct the education of children with disabilities in our country:
The No Child Left Behind Act was signed into law in 2001, reauthorizing the Elementary and Secondary Education Act. This was the first time that the law governing elementary and secondary education addressed the learning of ALL students.
The Individuals with Disabilities Education Improvement Act [IDEIA] of 2004 defines the requirements that states must follow to identify and serve students with disabilities. The final Part B Regulations [addressing children 3-21 years of age] were published in the Federal Register on August 14, 2006. The Part B regulations at 34 CFR Parts 300 and 301 took effect on October 13, 2006.
The Operating Standards for Ohio’s Educational Agencies Serving Children with Disabilities were adopted in 2002 to direct the implementation of IDEIA in Ohio with the Ohio Model Policies and Procedures.
