Laws & Regulations
The U.S. Department of Education issued the final Part B regulations to implement the Individuals with Disabilities Education Improvement Act (IDEIA) of 2004. An official copy of the final Part B regulations of IDEIA was published in the Federal Register on August 14, 2006. The Part B regulations at 34 CFR Parts 300 and 301 took effect on October 13, 2006.
The Operating Standards for Ohio School’s Serving Children with Disabilities rules in Chapter 3301-51 of the Ohio Administrative Code were adopted in 2002 in order to ensure that all children with disabilities have available a free, appropriate public education that emphasizes specially designed instruction that meets their unique needs. The Ohio Department of Education, Office of Exceptional Children is in the process of revising the current Operating Standards to be released during the 2008-2009 school year.
The No Child Left Behind Act (NCLB), Public Law 107-110 was signed into law in 2001, which reauthorized the Elementary and Secondary Education Act of 1965.
The resources attached come from Federal, State and local sources and are intended to be available to school district personnel to maintain compliance with federal and state regulations and to continue to strive for “best instructional practices” and “scientifically-based practices” for all student learners.
