English Language Learners

Based on Civil Rights of 1964, No Child Left Behind (NCLB) and the Supreme Court Decision: Lau versus Nichols 1974, there federal and State legal obligations of all school districts in serving English Language Learners. School districts are required by law (whether funded by Title III of NCLB or not) to:

  • Identify and assess all students whose home/native language is not English
  • Provide services for ELL students that are theoretically sound and based on good practice
  • Provide qualified staff and resources to implement district programs serving ELL students
  • Monitor and evaluate programs serving ELL students on an ongoing basis – and modify the program if necessary

The resources attached come from Federal, State and local sources and are intended to be available to school district personnel to maintain compliance with federal and state regulations and to continue to strive for “best instructional practices” and “scientifically-based practices” for this specific student population.
